Conditions of Use
1. Must
be 18 years of age or older to purchase. By placing an order, the purchaser
represents that he/she is of legal age, and that the products purchased will be
used in a lawful manner. BROOKHURST HOBBIES, will not be held
liable for the misuse of any item sold.
2.It
is the sole responsibility of the purchaser, not the seller to ascertain, and
obey, all applicable local, state, and international laws in regard to the
possession, shipping, and use of any item purchased. By purchasing any item from BROOKHURST
HOBBIES, the purchaser expressly warrants that he/she is in compliance with
federal, state, and local laws. The purchaser expressly agrees to indemnify and
hold harmless BROOKHURST HOBBIES or any of its officers, members,
managers, employees, or agents, for all claims resulting directly or
indirectly from the purchase, ownership or use of the item or items in violation
of applicable federal, state, and local regulations or laws.
3.By
placing an order, the buyer represents that the products purchased will be used
in a lawful manner and that the he/she is of legal age. If you are in doubt
consult your local and state laws before purchasing. BROOKHURST HOBBIES, will
not be held liable for the misuse of any product purchased from us or any of our
distributors and dealers.
4.ANYONE
attempting to falsify information or defraud BROOKHURST
HOBBIES in
any way, WILL be turned over to the proper authorities.
New York General Business Law § 872 provides that:
No person, firm, corporation or agent or employee thereof shall import, manufacture, sell, hold for sale or distribute within the state any imitation weapon unless such device is imported, manufactured, sold, held for sale and distributed:
1. Solely for subsequent transportation in interstate commerce; or
2. Solely for lawful use in a theatrical production, including a motion picture, television or stage production.
New York General Business Law § 870 further defines "imitation weapon" as follows:
"Imitation weapon" means any device or object made of plastic, wood, metal or any other material which substantially duplicates or can reasonably be perceived to be an actual firearm, air rifle, pellet gun, or "B-B"gun; unless such imitation weapon
(a) is colored other than black, blue, silver or aluminum,
(b) is marked with a non-removable orange stripe which is at least one inch in width and runs the entire length of the barrel on each side and the front end of the barrel, and
(c) has a barrel at least one inch in diameter that is closed for a distance of not less than one-half inch from the front-end of its barrel with the same material of which the imitation weapon is made.
Legal status of products
It is the responsibility of the buyer, NOT THE SELLER, to ascertain, and obey, all applicable local, state, federal and international laws in regard to the possession and use of any item on this site. All equipment is sold subject to public law 90-351, title III, U.S.D., Section 2511, and any local, state or federal ordinances. Consult your local and state laws before ordering, if you are in doubt. Absolutely no sales to minors! By placing an order, the buyer represents that the products ordered will be used in a lawful manner, and the he/she is of legal age.
